On 6 March 2014 the Verkhovna Rada of the Autonomous Republic of Crimea adopted the Resolution “On holding of Crimean referendum” which, particularly, envisages the annexation of the Crimea to the Russian Federation
and conduction of the referendum in the Crimea on 16 March 2014 on the following questions:
1) Do you support the reunification of the Crimea with Russia as an entity of the Russian Federation?
2) Do you support the coming back into force of the Constitution of the Republic of Crimea of 1992 and the status of the Crimea as a part of Ukraine?
In this regard, the Ukrainian side underlines that:
- Ukraine is a sovereign and independent state with integral, inviolable territory and any interference into the domestic affairs of the state is inadmissible;
- The Autonomous Republic of Crimea is an inseparable constituent part of Ukraine, on which territory the Constitution of Ukraine is applied;
- Decision by Verkhovna Rada of the Autonomous Republic of Crimea to hold the Crimean referendum on changing its status of being part of the state contradicts Article 73 of the Constitution of Ukraine as well as Articles 18 and 26 of the Constitution of the Crimea;
- According to the provisions of Paragraph 2, Article 85 of the Constitution, the Verkhovna Rada of Ukraine has exclusive right to designate the referendum on altering the territory of Ukraine;
- To put the abovementioned questions on the so-called “referendum” is considered to be the rough violation of the existing legislation of Ukraine, particularly, Article 73 of the Constitution of Ukraine and Paragraph 2, Part 3 of Article 3 of the Law of Ukraine “On an all-Ukrainian referendum”, which determine that issues of altering the territory of Ukraine are resolved exclusively by an All-Ukrainian referendum;
- The conduction of such referendum with violation of the Constitution of Ukraine and current legislation of Ukraine as well as any results of this referendum and further decisions, taken on their basis – are illegitimate.
